§ 16-120. Debarment or suspension of prospective contractors.

  • (a)

    The purchasing agent is authorized to debar a person, for cause, from consideration for award of contracts.

    (b)

    Debarment procedures. The following procedures shall govern the debarment decision-making process:

    (1)

    Notice to contractor. Debarment shall be initiated by advising the prospective contractor and any specifically named affiliate, by certified mail, return receipt requested, that debarment is being considered. Such notice shall include the reasons for the proposed debarment in terms sufficient to put the contractor on notice of the conduct or transaction upon which it is based.

    (2)

    Period of debarment. Debarment shall be for a period commensurate with the seriousness of the cause, as determined by the purchasing agent, but in no event for a period to exceed three years.
